All cases are unique and the circumstances in one may not apply in another.

However, many cases have similarities, especially with regard to the steps the case may go through. In this section, sample cases we have handled over the years are summarized. These cases are meant to provide enough information so you can better understand the types of medical malpractice cases we handle on a regular basis. These are brief summaries of a few cases in which we have succeeded in recovering significant damages for veterans, their families, and dependants of active duty military personnel. We cannot promise the same results for every case and every situation, but we’ll fight as hard as possible for you.

Retired Air Force Officer, Maryland

Nerve, muscle, and bowel injury, infection, permanent disability resulting from surgery at Air Force hospital

An administrative settlement was obtained on behalf of this veteran who suffered massive, unexpected complications during surgery to repair aortic aneurysm.

Retired Marine, Florida

Kidney and ureter damage at VA Medical Center. We filed suit and obtained a settlement on behalf of a veteran who was injured when a VA physician attempted to remove a kidney stone. His injuries included a torn ureter, kidney damage, infection, and partial loss of function.

Active Duty Air Force Spouse, Age 48, Virginia

Failure to diagnose impending heart attack An administrative settlement was obtained for a woman whose Air Force health care providers failed to properly evaluate her repeated complaints of chest pain, which would likely have avoided her subsequent heart attack.

Retired Navy Chief, Age 68, Nevada

Death due to delay in diagnosing colon cancer We filed suit against the United States and recovered damages on behalf of this veteran, who failed to receive colonoscopy or other appropriate colon-cancer screening at Air Force and VA clinics over the course of several years.

World War II Air Force Vet, Age 83, Texas

Death resulting from a fall and head injury The VA settled this claim, which alleged negligence in allowing an elderly, terminally ill vet to suffer head injuries due to a fall at a VA hospital. Restraint orders put in place to protect the patient had not been followed

Spouse of retired Air Force Master Sergeant, Age 52, Virginia

Death resulting from failure to diagnose infection. The United States settled this case after suit was filed on behalf of the surviving spouse and children. Death occurred after doctors and lab personnel at a U.S. Army community hospital failed to diagnose an infection which threatened the life of this woman, who suffered from pre-existing liver disease.

Army Vet, Age 36, Maryland

Death due to delayed diagnosis of bladder cancer A VA physician failed to obtain follow-up tests when this veteran reported blood in his urine. The result was a fatal delay in diagnosis of bladder cancer. This claim was settled without filing suit.

Air Force Vet, Age 74, Texas

Death resulting from a perforated esophagus This veteran died from respiratory failure while recovering from an injury she received during an upper GI examination at a VA hospital. We filed suit and the government settled the case.

Retired Air Force General, Age 69, Maryland

Death due to failure to treat coronary artery blockage A retired General obtained a state-of-the-art test which confirmed the presence of coronary artery disease. He informed his Air Force primary care doctors, who then failed to obtain needed follow-up over a sixteen-month period. The General suffered a massive heart attack and died. We filed suit against the United States and obtained a substantial recovery.

Retired Army First Sergeant, Age 73, Alabama

Failure to diagnose clogged coronary artery bypass graft VA emergency room personnel failed to admit and treat this vet despite abnormal EKG, chest pain, shortness of breath, and a cardiac history. The man was sent home, where he suffered a heart attack. We obtained a recovery for the vet and his wife after filing suit against the government.

Retired Army LT COL, Age 49, Florida

Failure to treat signs of stroke, resulting permanent disability We obtained a recovery in litigation on behalf of this retiree, who reported to an Air Force emergency room after experiencing a sudden, partial loss of vision. Doctors suspected a stroke, but due to delays and administrative errors, no treatments were provided in time to avoid his permanent visual and memory deficits. One-month-old Marine Corps dependent Arm injury with permanent disability Washington, D.C. The infant son of a Marine NCO was hospitalized at an Army hospital for routine surgery. Negligence on the part of a civilian nurse allowed intravenous saline solution to infiltrate the tissues of the babyís arm. Surgery and extensive tissue removal and cosmetic repairs were required, and the child is expected to suffer a permanent partial arm disability. Our firm filed suit and recovered for the child and his parents.

 

Death resulting from delay in diagnosis of lung cancer The VA settled this claim which alleged failure to obtain follow-up treatment for more than fourteen months after this veteranís CT films were noted to show the presence of an enlarging lung nodule.

 

Army Veteran, Age 58, Oregon

Failure to diagnose mouth cancer An administrative settlement was obtained for this veteran after VA dentists failed to follow-up an enlarging ulcer on his tongue, which was ultimately diagnosed as cancerous. The veteran suffered pain, more extensive tissue loss during tongue surgery, and permanent speech impairment due to delay in diagnosis.

Air Force Vet, Age 67, Tennessee

Ear injury during cleaning procedure This case resulted in an administrative settlement for a veteran whose ear was burned by caustic solvent during a cleaning procedure. He suffered additional hearing loss and underwent repair surgery.

Spouse of retired Marine Corps Officer

Death due to delay in diagnosing nasopharyngeal cancer Washington, D.C. We obtained an administrative settlement for the surviving spouse after Army primary care doctors failed to refer his wife for specialist evaluation despite her long-standing complaints of blood-tinged mucous and chronic cough.

Navy Veteran, Age 56, Virginia

Skin discoloration due to medication The VA settled this claim, which was brought on behalf of a woman who reported an allergic reaction to pain medication after treatment in a VA emergency room. Her medication was not discontinued despite prompt complaints and multiple return visits, and the delayed diagnosis of allergic reaction caused permanent skin discoloration on her face and arms.

Spouse of retired Air Force Officer, Age 51, California

Ureter clipped during pelvic surgery We filed suit and made a recovery on behalf of this woman and her husband after she suffered loss of a kidney due to ureteral clipping during pelvic surgery. The injury was not discovered for several years, during which time the woman had suffered from chronic pain and loss of energy.

Marine Corps Veteran, Age 49, North Carolina

Death due to delay in treatment of coronary artery disease The VA settled this administrative claim. The veteran died while awaiting routine cardiac stress testing despite clear signs of unstable angina and the need for an urgent cardiac work-up.

Air Force Veteran, Age 68, Oklahoma

Delayed diagnosis of colon cancer We recovered for this veteran and his wife after filing suit against the government based on the VAís failure to provide colonoscopy or other appropriate colon cancer screening during years of primary care treatment. When this gentlemanís cancer was finally diagnosed, he required extensive surgery and a permanent colostomy.

Army veteran, age 64, who suffered complications due to delayed VA diagnosis and treatment of prostate cancer. Substantial settlement obtained. 

Settlement was obtained for an Air Force veteran, age 66, who suffered leg amputation due to VA delay in diagnosis and treatment of vascular insufficiency. 

Administrative recovery obtained for an Army veteran, age 85, who suffered painful injury when VA emergency department personnel yanked-free a urinary catheter without first deflating the device. 

Settlement in favor of an Army veteran, age 71, who was injured by delay in diagnosis and removal of a non-cancerous mass in his colon. 

Recoveries obtained for Army and Navy veterans, both age 58, who suffered leg amputations following VA delay in diagnosis and treatment of vascular insufficiency. 

Administrative settlement obtained for estate of Army veteran, age 71, who died following VA delays in diagnosing and treatment of symptoms of impending heart attack. 

Settlements in favor of an Air Force reservist, age 39 and Army veteran, age 87, who suffered injuries resulting from VA’s negligent performance of gallbladder surgery. 

Recovery for the spouse of Marine Corps veteran, age 45, who suffered facial burns during Navy cosmetic surgery procedure. 

Settlement in favor of a Navy veteran, age 55, who died as a result of VA delay in diagnosing and treating bladder cancer. 

Settlement obtained for the family of a Marine Corps veteran, age 55, who died as a result of VA delay in diagnosing and treating colon cancer. 

Litigation recovery in favor of an Air Force spouse, age 36, who suffered injury due to unsanitary conditions of childbirth, and delay in diagnosing and treating resulting infection. 

Settlement in favor of the estate of a Marine Corps veteran, age 71, who died as a result of VA delay in diagnosis and treatment of an inner ear tumor. 

Recovery in favor of the daughter of an active duty Air Force family, age 11, who was injured as a result of delay in diagnosing and treating infection.
